If after 40 days no one has challenged your claim, you can do a ‘follow-up’ with a UCC 3 as this helps to make your claim solid and come together. A: No, you do not have to be a secured party creditor before completing this process. In fact, you do not even have to have your status corrected either to do this process. If you are an SPC and have already corrected your status, even better! If not, that’s okay too.
Q: Do I have to get the MCO to my car to complete this process?
A: It’s not necessary to obtain the MCO to your car to complete this process, but if you’d like to do so, then this will only make your request and claim stronger.
Q: Do I have to have my car paid in full?
A: No, you don’t have to have your car paid in full either to complete this process. Whether you discharged your car’s debt off or not, you can do this process of obtaining allodial title over your car since it’s your lawful right to do so.
Q: Can I still claim allodial title for my car if I am leasing or renting it?
A: If you are renting a car, no. This process will not work on car rentals.
In regards to leased cars – unless you planned on keeping the car that you leased after the lease agreement is finished, then you can claim allodial title for the car as well. However, if you are not allowed to keep the car after the lease agreement is finished, then you could not do the allodial title process for your car as you don’t actually (lawfully) own the car.
Q: Can I still claim allodial title if my car is protected in a trust?
