What happens if they don’t answer to your counterclaim?
We would help you send the default notices to the Department of State Passport Division. If they continue to do a ‘failure to respond’, you can consider filing a lawsuit, suing for a couple of million dollars, including citing the consumer laws. Please note that if you pursue the lawsuit route, that is a separate process.
Having your status corrected is crucial and highly recommended to undergo a state national process before following this step. If you do not have your status corrected, that is fine too but recommended. You don’t have to be an SPC but it does help if you are. If you are a state national already, that suffices.
